AUSTIN (KXAN) – Quinton Duane Baker didn’t forget to eat his greens during a June 30 traffic stop in North Austin, Texas according to police.
The traffic stop occurred at a Walgreens location near the intersection of Interstate 35 and Cameron Road. When an officer approached 38-year-old Baker’s car, he said he smelled a strong odor of fresh marijuana. The officer also said he saw small green leaves on Baker’s shirt and the suspect was “feverishly chewing something in his mouth.”
The officer asked Baker to open his mouth, but Baker was hesitant, according to the affidavit.
When Baker stepped out of his car, he grabbed a drink and “took several big gulps,” the affidavit states. “As Baker exited the vehicle he began to choke on the contents in his mouth and began to spit it up.”
Within the spit that landed on the ground, the officer found green bits suspected to be marijuana. An officer gathered it as evidence, according to the affidavit.
The officer said he also saw a green substance in Baker’s cheek and in his teeth. Baker has been charged with tampering with physical evidence, a third-degree felony.
Texas Department of Public Safety records show Baker has two previous convictions, including one for possession of marijuana and another for evading arrest.
