Gate City man accused of firing at deputies charged with attempted murder

SCOTT COUNTY, VA (WJHL) - A Gate City man accused of shooting at deputies has been charged with attempted capital murder, that's according to the Scott County Commonwealth's Attorney.

Roy Michael Barnett, age 49, is recovering in a Kingsport hospital after he was shot by sheriff's deputies on Tuesday night in at a home on Daniel Boone Road in Scott County, Virginia.

Sheriff John Puckett says around 8 p.m., two deputies were trying to serve an emergency custody order to take Barnett in for a mental evaluation.

The sheriff says the officers identified themselves, and that's when the man in the home stuck a gun out of the door and opened fire.

Sheriff Puckett says officers returned fire wounding the man.

He was taken to Holston Valley Medical Center in Kingsport where he underwent surgery. According to Virginia State Police, Barnett's injuries were non-life threatening. 

The sheriff's deputies were not hurt.

Virginia State Police is leading the investigation into the officer-involved shooting. 

Puckett said officers have been to the same home on previous occasions to serve emergency custody orders for mental evaluations on Barnett. 

He said he plans to let his officers determine whether they'll be on administrative leave.
