Codey Miller, accused of killing, raping mother, set to go to trial in June

A man accused of killing his mother, raping her and then dumping her body in a garbage can will go to trial on June 3rd if a plea deal cannot be reached.

Judge Robert Cupp set a trial date today in the case of Codey Miller.

Johnson City police arrested Miller in May 2009 after his mom's body was found in a trash can outside her home. Miller is charged with first-degree murder in the death of that woman, Sherry Cooper.

If the case goes to trial in June, more than four years will have passed since Cooper's death.

"Mr. Miller maintained his innocence from the beginning and still does so, so we will prepare for trial in June," Public Defender Jeff Kelly said.
